Terms of Service

By accessing or using HealthBooking (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We may update these Terms from time to time, as described in the Changes to These Terms section below.

You must be at least 18 years old, or have the legal capacity to enter into binding contracts under the law of your country of residence, to create an account or submit a quote request on the Platform. By using the Platform, you confirm that you meet this requirement.

If a request is submitted on behalf of a minor or a person who lacks legal capacity, it must be submitted by a parent, legal guardian, or authorized representative, who accepts these Terms on that person's behalf.

HealthBooking is a marketplace that connects patients with independent, third-party hospitals and clinics ("Partner Clinics"). We help you discover clinics, compare treatments and pricing, and request quotes.

We do not provide medical treatment ourselves. We are not a healthcare provider, and we are not a party to any treatment agreement, consent form, or medical contract between you and a Partner Clinic.

Any personal or health-related information you share with us through a quote request or your account is processed in accordance with our Privacy Policy, including the additional safeguards that apply to special category (health) data under the GDPR, where applicable.

The information on the Platform, including clinic listings, treatment descriptions, and cost estimates, is provided for general informational purposes only and does not constitute medical advice. Always consult your own physician or another qualified healthcare provider with any questions about a medical condition, and before making any decision about treatment abroad.

The Platform is not intended for medical emergencies. If you believe you have a medical emergency, contact your local emergency services immediately.

Travelling abroad for treatment carries risks that are outside our control, including fitness to fly, visa and travel document requirements, currency fluctuations, language barriers, and complications that may arise after you return home. You are solely responsible for assessing these risks and for arranging appropriate travel and medical insurance.

Clinics listed on HealthBooking are independent businesses, not our employees, agents, or subsidiaries. Before listing a clinic as a partner, we review it against accreditation and quality criteria described on our Our Standards page.

While we take this review process seriously, we do not guarantee any specific treatment outcome, and we are not responsible for the acts or omissions of any Partner Clinic, including but not limited to the quality of care provided, complications, or scheduling changes.

Quote requests submitted through HealthBooking are forwarded to the relevant Partner Clinic. Any resulting booking, deposit, payment, or treatment agreement is between you and the clinic directly, unless we clearly state otherwise at the time of booking.

• Prices shown on the Platform are estimates provided by clinics and may change after a full medical assessment.
• Cancellation and refund terms are set by each Partner Clinic and will be shared with you before you confirm a booking.
• We are not a payment processor for treatment fees paid directly to a clinic.

To use certain features (such as saving clinics or tracking quote requests), you may need to create an account. You are responsible for:

• Providing accurate information when creating your account
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

Notify us immediately at info@healthbooking.eu if you suspect unauthorized use of your account.

By creating an account or submitting a quote request, you consent to receive electronic communications from us relating to your account, your quote requests, and the operation of the Platform. Where you have opted in, we may also send you marketing communications, which you can opt out of at any time using the unsubscribe link in the message or by contacting us at info@healthbooking.eu.

If the Platform allows you to submit reviews, ratings, photos, or other content ("User Content"), you agree that:

• Your User Content reflects your genuine experience and is not false, defamatory, or misleading;
• You will not submit User Content on behalf of a clinic you are affiliated with, or in exchange for payment or any other benefit, without clearly disclosing that relationship;
• You grant HealthBooking a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your User Content on the Platform and in our marketing materials;
• We may remove, edit, or refuse to publish any User Content at our discretion, including content we reasonably believe to be fake, abusive, or in breach of these Terms.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Submit false or misleading information in a quote request
• Attempt to interfere with the security or proper functioning of the Platform
• Scrape, copy, or reproduce clinic or platform content without permission

The Platform, including its design, text, graphics, logos, and the HealthBooking name and marks, is owned by HealthBooking or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

The Platform may contain links to Partner Clinic websites or other third-party sites that are not owned or controlled by HealthBooking. We are not responsible for the content, accuracy, or practices of any third-party site, and including a link does not imply our endorsement of it.

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

To the fullest extent permitted by law, HealthBooking, its founders and employees are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or your treatment at a Partner Clinic, including but not limited to medical complications, travel disruptions, or financial loss.

Our total liability arising from your use of the Platform, if any, will not exceed the amount (if any) you paid directly to HealthBooking in the twelve months preceding the claim.

You agree to indemnify and hold harmless HealthBooking, its founders, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or any information you submit that is false or misleading.

We may suspend or terminate your access to the Platform, in whole or in part, at any time and with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or posed a risk to other users or Partner Clinics.

You may stop using the Platform and close your account at any time by contacting us at info@healthbooking.eu.

We may update these Terms from time to time to reflect changes in our services or for legal reasons. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of Poland, without regard to conflict of law principles, and without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

Before pursuing a formal complaint, we encourage you to contact us directly at info@healthbooking.eu so we can try to resolve the issue informally.

If you are a consumer resident in the European Union, you may also submit a complaint through the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Any dispute not resolved informally or through that platform will be subject to the exclusive jurisdiction of the courts of Poland, unless mandatory consumer protection law provides otherwise.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HealthBooking regarding your use of the Platform.

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, or infrastructure failures.

You may not assign or transfer your rights under these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Any legal notice to HealthBooking should be sent to info@healthbooking.eu. We may send you notices relating to these Terms to the email address associated with your account or the one you provided when submitting a quote request.

These Terms are drafted in English. Any translation provided is for convenience only, and the English version will prevail in the event of any conflict.
